Barratt American has lost it's Bank of America loan. Recall that not to long ago Barratt American bragged about it's record profits. Barratt is also being sued by their unpaid sub-contractors.

The Quiet War against Leucadia's Tree Canopy

Leucadia's logo is an old growth tree.

FYI to all the Leucadia faithful, some of the most influential people in Encinitas are drinking the "Leucadia's trees are at the end of their life cycle so let's cut them all down" kool-aid and spreading it around.

If you meet one of these people do not panic for they are mostly harmless. They tend to be nice people, just misinformed. It's up to all of us to set these folks straight.

The propaganda war against Leucadia's heritage tree canopy seemed to begin with the hired gun from the NCTD (who have a scorched earth policy against Leucadia).

The most common piece of twisted logic you hear is, "We have to cut down all the trees and plant new ones so in 50 years we can have a nice big tree canopy."

This makes little sense, why cut down what you already have-in order to achieve what you already have? And, in 50 years some knucklehead is just going to try and cut down ALL of those trees and the whole sick cycle begins again.

The trees ARE NOT at the end of "their life cycle". Trees are not like humans and other mammals, they don't live for 100 years and then drop dead. Trees have no set end date, trees will live on for hundreds of years if given a chance. Look for more detailed post on this all this week.

There are thousands and thousands of eucalyptus trees older and bigger than Leucadia's trees around San Diego county.

Warning, the majority of anti-tree talk is coming from NON-Leucadians. Why are non-Leucadians piping in on this?

Some of the anti-tree talk is ironically coming from people who have done good work with preservation and with our local historical society. I would rate preserving Leucadia's heritage tree canopy with preserving the Boat Houses and the La Paloma.

The tree canopy is what makes north Hwy 101 unique. We are letting the trees vanish, this means less shade for pedestrians, less ambiance for tourist and locals and a more bleak tone.

Have you walked the non-tree zones of Leucadia in the summer time? It's hot and sweaty my friends.

We need a urban tree management plan for the entire city of Encinitas. We need to protect our classic old growth trees, trim their dead branches, feed and water our trees and plant new ones so we can preserve and improve the ambiance of our hometown.

The only city council candidates for election 2008 who has made preserving our trees a major issue is Bob Nanninga and Rachelle Collier so keep that in mind.

“A Toll-tally Lame Meeting”

The first time I wrote about Toll Road 241, I was proud to be an American, because it looked like we were going to prevail, so naturally, I was feeling patriotic. Today, I am not so happy. I am ashamed to be part of the human race, if the truth be told, and it’s not because the road might actually be built, but I am saddened by the way we, the public were treated, and the utter disregard and disrespect shown by the Del Mar fairgrounds, the TCA, (the crooks that are financing this boondoggle), and the National Oceanic and Atmospheric Administration. After the Coastal Commission voted down the project, the TCA appealed, and stated that because of the “circus like atmosphere”, they wanted to deny the public any access to their meeting with the NOAA.



So we got a compromise, if you want to call it that. We got treated like cattle. We got treated like crap. Anyone wishing to speak had to send a letter via snail mail, and that didn’t guarantee you would be chosen to speak. You could not donate time another speaker, and even if you were a politician, like Pam Slater (who was in Washington), you could not have an assistant or representative to speak on your behalf. That was forbidden. No, boys and girls, these were the Feds and they were calling the shots.





The meeting was held in a huge room with no air conditioning. You were not allowed to bring any water into the room. You could not hold signs over your head. Unless you were the media, you weren’t supposed to take any pictures, and the parking fee was a whooping 9 dollars per car. The sound system was ridiculous and it was impossible to hear what anyone was saying. When I was in the bathroom I almost felt like I was in an old church, the echoing was so bad. We weren’t supposed to clap. We weren’t allowed to cheer. I was asked to sit down several times. Our only form of expression and/or protest was to hold our thumbs up, or down. Quite a few of us starting waving dollar bills in the air when appropriate and one guy showed me how to hold my money using my middle finger, which I did with relish and there wasn’t a damn thing the security could do about it.



I walked around and took pictures anyway, and while I was aiming at the pro toll road people, who were paid to be there, a security guy asked me if I was from the media. I lied and said I was a free lancer. “Oh, OK”, he said. However, an hour later, when he noticed I was taking pictures of everyone, he asked to see my “Media pass”. “I don’t have one, I’m a free lancer, remember?”, I said. “Then you can’t take any pictures. I don’t make the rules.”


Two hours into the meeting, I guess the Feds had enough of letting us exercising our rights, and a woman in a black power suit with a walkie talkie started making the rounds, checking everyone out and making people obey the rules. Of course, I noticed she only mingled with the side of the room that had the potential to become a “circus” and ignored the other side of the room- the pro toll road folks in their ubiquitous orange shirts. It was a rainbow coalition of security, I must admit. There were regular police, sheriffs, the ELITE guys, Del Mar Fairgrounds staff and who knows how many undercover agents.

As for the speakers, I will say this much. The pro toll road people were the best dressed hookers I’ve seen in a while, oh yes, indeed. Oh yeah, check this out: did you know that the toll road will help National Security? If we have a catastrophic earthquake, it’ll come in handy! The surf won’t be affected at all, in fact the waves will be even better! They’ll be less crowded! On yes, all true, all true. Hell, maybe global warming will get better because more cars will be traveling less miles and fewer emissions will be created! The endangered animals will find new places to live and they’ll be even happier in their new locale. The birds will be able to migrate easier because now they’ll have a nice big freeway to point them to their destination!! Never once did anyone bother to mention that a toll road cost money to drive on each and every time you use it, but hey, that’s what credit cards are for, so no biggie.


And then… there’s the children. Think of all the happy kids that get to drive on the toll road when they grow up! It’s a win-win, people. Like one of the signs outside said, are you willing to sacrifice you lifestyle because of all this “disinformation”? Are you willing to sacrifice your entitled place on this planet where you get to consume as much as you want and use as much as you desire because that’s THE AMERICAN WAY? No way, man! I want my toll road and I want it NOW!


Tell you what, this time the pro toll roaders were expertly organized. We, the people against it, were organized, but we should’ve kicked ass this time, and I’m sorry to have to report this, but, we didn’t. If Good is to triumph over Evil, we must make our voices heard and we must go to the next meeting and pack the house. Even if it does mean shelling out 9 bucks for parking.

TAXPAYER ALERT: Trestles Toll Road Hearing Today at Del Mar Fairgrounds

WHEN, WHERE
The hearing will be held on September 22, 2008 in O’Brien Hall at the Del Mar Fairgrounds, 2260 Jimmy Durante Boulevard, Del Mar, CA 92014.

WHAT TIME
The hearing will begin at 10:30 a.m., and end promptly at 8:30 p.m. Public should arrive by 10am. Come for two hours, four hours, or the entire day if you can.

MOTOR HOMES, RVS
Yes, but be advised that front row parking can not be arranged in advance. To ensure the best possible front parking, we recommend that large vehicles arrive before 9am.

WHO SHOULD ATTEND
You . The “sweet spot” will be from 10:30am – 1pm.

WHO WILL SPEAK
Only those who have requested in writing to speak will be allowed time at the podium – 3 minutes for individuals, 5 minutes for representatives of organizations and elected officials.

MORE SCHEDULE
A 30 minute intermission will be called at 2PM and again at 5PM. Other recesses may be called as necessary by the hearing officer,

HOW MANY PEOPLE WILL BE THERE
The venue holds 6,000 people, considerably larger than Wyland, which held 3,500 max.

WHAT WILL HAPPEN
The Department of Commerce will be sending legal representatives from NOAA, which is a division within DoC, who will chair and conduct the meeting. They will hear from the public but will not make a decision at the meeting. Rather they will return to Washington D.C. And report to the Secretary of Commerce. He will make the decision and respond to TCA before the end of November. If he refuses TCA’s appeal to overturn the CA Coastal Commission’s decision, the alignment on the table will be dead. If TCA wants to pursue another alignment, they will need to create a new process to do so. In other words, the Save State Parks – Save Trestles campaign will have been won. However, if the Secretary of Commerce approves TCA’s appeal, then TCA will continue on its path to build the road, which means it will still need approval from seven other government agencies before construction can begin. One of those seven agencies is the CA Coastal Commission (again). The road could get shut down at that juncture but we do not want it to go that far. WE WANT THIS STOPPED NOW.

Oh, yes, that was fine and dandy. Everybody was making money, and the owner of the home kept borrowing and living beyond their means. Now they have to live beneath their means.

Paul had nothing but disdain for Republican presidential nominee John McCain's suggestion to create a new government entity to deal with the crisis, calling it "just more of the same, more government, more programs, more spending, more regulations, trying to prop up a system that has been undermined."

He did say that Democratic candidate Barack Obama "has a pretty good grasp on how to attack this politically and go after McCain, but he doesn't have any answer. He's not talking about the Federal Reserve system. He's not talking about balanced budgets. He's not talking about bringing troops home from Afghanistan."

Currently there are five roundabouts proposed. One at El Portal is in the first phase of the streetscape project, and does not involve encroachment into private property. The other four are in future phases.

If, and it's a big if, NCTD allows their right of way to be used, then no encroachments to private property at any of the locations..

If not, two of the locations Including El Portal by Leucadia Glass, would have no encroachments on private property.

Two locations would have very small encroachments to the planter/landscape areas of private property but would not impact parking or buildings.

One location which is Grandview would have very significant encroachment and impacts to building(s) on either the north or south of the intersection.

It is my opinion as an individual, that if an agreement with the property owners can be mutually reached, this would be possible but with a unknown cost at this time. If neither property owner wants it, it will not happen. I seriously doubt that anyone would support eminent domain and a forcible taking. I would not.

Hope this helps.

I also support Rick and Ray [Leucadia Glass and Sub Palace], and their right to petition and present their views. Their efforts are to help the project by voicing their opinion. These comments are offered honestly and should be respected. That's what open and transparent is, as opposed to boycotting or not shopping somewhere because of a point of view on one issue that Simonne disagrees with.

A person may or may not agree with the comments, but all should be encouraged to participate without being bullied. That is the way that we will get the best community designed streetscape project.

Ultimately we will only get to build this one way, one time, and not everyone will agree with everything in the plan. I hope that most will agree with most of what is in the ultimate final plan.

What we can all do is be advocates to get as many folks involved as possible.

Streetscape Reaction

Here is the North County Times article about last nights Streetscape discussion at the Planning Comission:ENCINITAS: Consultants explain streetscape alternatives

Two of the alternatives call for as many as five roundabouts to be installed along the highway at El Portal, Jupiter, Grandview, Sea Bluff and La Costa Avenue.

The idea of building roundabouts didn't go over well with some community members, however. Building them to calm traffic would be foolish, said Rick and Kathy Smith, who own Leucadia Glass on Coast Highway.

The Smiths are being harshly criticized for being anti-roundabout but what the newspaper fails to mention is that the Smiths will lose their building to eminent domain to make room for the roundabout. This is because nobody in this town has the savvy to convince the NCTD to surrender 9 feet of crappy wasteland dirt for the roundabout thus leaving a longtime small business and outstanding member of the community to lose everything. No good deed goes unpunished eh?

Planning Comission Discussing Leucadia Streetscape right now

I just got home and realized that the Planning Commission is reviewing the north Hwy 101 portion of the Leucadia streetscape tonight. So, if you are sitting at home reading this get over to city hall. A member of the Leucadia 101 Mainstreet will be reading a letter with a list of wishes, desires and concerns regarding the streetscape.

The streetscape is Agenda item #8 so you probably still have time to get there and fill out a speaker slip.

Cardiff Candidate Forum

Unfortunately I was not able to attend the first candidate forum held in Cardiff and hosted by the lovely Barbara Cobb.

It sounds like there was a decent turnout. It had to be tricky to moderate a forum with an incredible 10 candidates vying for 3 seats.

A few years back, a guy named Clay asked me if he could have some stalks from our bamboo plant (that we were plagued with for 40 years). Sure! No problem. I didn't know him well but coincidentally I know two of his brothers pretty well.
I didn't see Clay for a year then he showed up with numerous bamboo flutes he had made from the bamboo. I helped him sell a few of them.
One night I was at Keno's with my camera I thought of recording Clay and one of his flutes to post on Youtube and maybe get him some sales that way. The 2nd generation video is attached below. It was completely unscripted and spontaneous as I said basically "Sell me a flute while I videotape you for the Internet". So with a little light in the dim recesses of Keno's I rolled the camera.

I was shocked to hear today that Clay was the man shot and killed by the new security guard where I do my laundry every week. My heart goes out to his mom, brothers and girlfriend.

Shopping centers instead of sports fields? Why does Carlsbad hate children so much?

Since so many people from Carlsbad showed up to an Encinitas city council meeting demanding that Encinitas taxpayers pony up the $35-$50 million it will take to build the Hall Park sports complex, I figured it might be easier if we all just built the park at the 50 acre future site of the Ponto Beachfront Village instead of the 44 acre site in Cardiff.

Check out this quote from Encinitas city councilperson Dan Dalager from this SDUT story on Aug. 24 2008:

“When I was a kid, we always had open fields and vacant lots and nobody used them, so you'd go out there and get exercise,” Dalager said. “Kids obviously can't do that. As we get more densely populated, you have to plan and you have to create these places.”

Dalager is on to something here, why does the park have to cost $35-50 million dollars...to play soccer?!?

Soccer is popular all around the world in every economy. It cost almost nothing to play, you just need a ball, some friends and an empty field. Why can't the Hall Park just be wide open grassy fields? Why the mega-park?

At the very least, we could grade the land, plant grass, and water and mow the fields and the let the kids run around and play soccer. The adults can even keep score and write GO LINDSY #1 on the windows of their SUV if they want.

Stop the senseless train dust pollution

Friends that live on or near North Vulcan Avenue -

Years ago there was more ice plant and mulch along the train tracks that
would help keep the dust (pollution) down when the trains went by, etc.
This changed when the drainage ditch was dug to assist with the flooding
issues. Mulch was never added after the ditch was dug and the ice plant is
limited to a few areas.

The following is copied from the San Diego Air Pollution Control District
website:

"Prohibition against causing a public nuisance. California Health and Safety Code [
http://www.arb.ca.gov/bluebook/bluebook.htm ] Section 41700 states that no
person can discharge air contaminants that cause injury, nuisance or annoyance to any considerable number of persons or the public, or discharge air contaminants that endanger the comfort, health or safety of such persons. If a business violates this prohibition or any other air quality requirement, the District may issue a Notice of Violation to the business.

If a Notice of Violation is issued, the business must take action to correct the violation and pay a monetary penalty to the District.

Penalties are determined in accordance with Health and Safety Code Sections 42400 – 42403."

Maybe the PTA for Paul Ecke Central could start a petition and encourage all members to send in a complaint considering NCTD is polluting our kids lungs while they are out running around in the playground.

Dalager: Better than Reality TV

If you remember JP's golden blog post about Dalager being untouchable you would have been rolling in the aisle Wednesday night (see Dalager celebrates election victory by clubbing baby seals).

The council was discussing a plastic bag policy for the city.

This guy above said something along the lines of:
Allowing more plastic bags to go in the ocean is killing baby seals. So not stopping the plastic pollution is like clubbing baby seals.

Classic.

Dalager and Stocks ended up voting against Houlihan, Bond, and Barth on the plastic bag policy.

Dalager said some things very close to:
"There is a reason why plastic has become so popular"
"We just stocked my fish pond with a plastic bag filled with fish"

I fell out of my chair on that one... when the audience was worried about the plastic killing fish.

Some other Dalager quotables:
"Americans love change but dread revolution"
"But remember the flies? I do, in my mom's kitchen."
"I would go along with a ban if we can't come up with something better."

JP's NOTE-The council did not ban plastic bags on Wednesday. They gave direction to staff to return with a ordinance to phase-in the elimination of single use bags (paper & plastic). Teresa Barth specifically requested that it have a large public education component.

Health Alert: West Nile Virus Found in Encinitas

We received this notice at city hall today from the County Department of Environmental Health:

On August 28, 2008 the Department of Environmental Health Vector Control
Program trapped adult mosquitoes as part of the routine monitoring of
adult mosquitoes in the Encinitas Creek area. One mosquito sample (17
mosquitoes) from the trap was analyzed by U.C. Davis for the presence of
mosquito-born viruses.

The results were returned to Vector Control on
September 5, 2008 as being positive for West Nile Virus (WNV). The
location of the mosquito trap is in the Encinitas Creek region near
Village Square Drive. To date there have been 12 West Nile
positive dead birds retrieved from the City of Encinitas.


The WNV positive mosquito sample, as well as the presence of the dead
birds is strong indicators of the presence of WNV in the area. The
Vector Control Program is taking the following actions:

1. Mailing out precautionary letters to the residents of Encinitas in
the potentially infected area.

2. VCT staff will canvass the neighborhood and conduct an aerial search
for un-maintained swimming pools

3. VCT staff will be searching the adjacent creek and storm water
drainage courses this week for evidence of breeding and treat with
larvicide as needed

4. VCT staff has placed more mosquito traps in the area. These will also
be sent to U.C. Davis for testing

5. A press release has been issued regarding the positive mosquito
samples and personal protection information.

Art Walk Dead Zone: Phoebe St Post Office Area

The recent Leucadia Art Walk was a reasonable success with an estimated 2500+ visitors. All the small businesses looked like they were really benefitting from the foot traffic, so I found it odd that the owner of the small and perennially slow Leucadia Surf Shop had posted hand written NO PARKING signs. The above photo was taken on Art Walk day!

This would have been a great location for artist and musicians and a beverage cart and the surf shop could have sold some Leucadia t-shirts. Why wasn't this location utilized?

N. Leucadia Pedestrian Hell

The Leucadia Streetscape calls for ambitious multi-million dollar plans that include radical realignment of the highway and tree canopy and threat of eminent domain to install large Bird Rock, La Jolla style roundabouts. All we really want is safe passage down the street.
