Barth Writes About Hall Park

Re: “A Park for Encinitas / Vote ends nine years of obstructionism” (editorial, Feb. 21):
Union-Tribune editorials have consistently supported the development of the Hall property as a regional sports park even though there is overwhelming support for a multi-use community park.
At the Oct. 21 council meeting, staff requested authorization to issue a request for proposals for clearing the property.
Councilman Dalager, supported by then-Mayor Houlihan, repeated his interest in preserving the Hall House, a unique adobe structure. Chris Hazeltine, director of Parks & Recreation, responded that further discussion could take place when the contract was brought to the council.
Councilman Stocks stated that Dalager had been talking about saving the house since 2001. The issue could be discussed at a later date and “we can always remove projects at that time.”
Councilman Bond also stated that “we can have another bite at the apple” when we see the demolition contract.
I offered a compromise by asking staff to return with the proposal so changes could be made before going out to bid. My compromise was not supported.
It was obvious from the discussion at that meeting the council expected to study the issue further. No specific agenda item was needed.
At the Feb. 24 council meeting, a number of public speakers brought forth additional information [SEE IT HERE]. Their research discovered that at a 2008 council meeting, Dalager, Stocks and Bond voted to save the Hall House as part of the approval for the park’s major use permit.
Yet, for reasons unknown and at whose direction, the staff decided to ignore the previous council decision and withheld that information at the 2009 and 2010 meetings.
So why now blame NIMBYs and call it an 11th-hour proposal? Why the need to create more acrimony in the community? Is this a prelude to the disinformation we can expect as the November election approaches?
Traditionally, editorials are based on fact. “A Park for Encinitas” falls far short of that benchmark.

  3. What would a Grand Jury do? There needs to be something illegal for the Grand Jury to become involved. What exactly is going on in this City that is illegal and provable. Have to have facts not just speculation.

  5. A friend told me that Dr. Lori was talking to the D.A. about something. My friend didn't know what it was about. He just saw her talking with the D.A. Maybe she would know how to get a Grand Jury to look into the Citys bad boys. Just a thought.

    The civil grand jury rarely investigates illegal behavior. They look for bad government practices. Look it up.

  11. A grand jury is meant to be part of the system of checks and balances, preventing a case from going to trial on a prosecutor's bare word. A prosecutor must convince the grand jury, an impartial panel of ordinary citizens, that there exists reasonable suspicion, probable cause, or a prima facie case that a crime has been committed. The grand jury can compel witnesses to testify before them. Unlike the trial itself, the grand jury's proceedings are secret; the defendant and his or her counsel are generally not present for other witnesses' testimony. The grand jury's decision is either a "true bill" (meaning that there is a case to answer), or "no true bill". In the state of Louisiana there is a third option, "By pretermitting entirely the matter investigated". This requires nine of the twelve grand jurors to determine there is not enough evidence presented to determine if a person should or should not be charged with a crime.[9] Jurors typically are drawn from the same pool of citizens as a petit jury, and participate for a specific time period.

  12. Unfortunately, prosecutors in San Diego can present false and misleading testimony to grand jurors, and not be held accountable for such things. You can indict just about anyone with a one-sided argument that isn't true.
    Prosecutors also use grand jury indictiments to make end runs around Preliminary Hearings.

  13. Good for Teresa, this is just the beginning of the dissing dis-information we can expect from The Onion before the Nov. elections. She has made a resounding point...Council is not in charge of this City!!!!! Council makes decisions and the STAFF OVERRIDES THEM! Uh, isn't this illegal? Doesn't this action plan violate the charter of the City? Isn't state money at risk when the City violates the charter? This is the same crap that happened when "maximize the sports fields" language was inserted into the Hall plan...nobody knew where that came from but we know staff put it there. When councilmembers, Bond, Stocks, Dalager and unfortunatey now Houlihan, violate the City charter by voting one way and winking when staff implements something different, there is a problem in River City, it's called Dirty Pool. Time to flush the bowl.

  16. The civil grand jury and the grand jury are two differnt groups. Civil looks at governmental wrongdoing. The other reviews citizens.

    the way you get the bums out of Leucadia is the get on their case about everything! And I mean everything.....

    When they sleep, yell, honk horns and wake them....when they are loitering yell at them to get a job. When they ask for money, scream for the police.... when they piss somewhere call the police and press charges. If you don't like the bums hanging out... do something and lets clean up Leucadia again. They will realize Leucadia is not easy living for them and they will move somewhere else.

    The bums are trouble, steal stuff, spread disease, and many are sex offenders. If you want your kids to be safer in Leucadia, get rid of the bums. Clean up Leucadia, get rid of the bums.

  21. No. I just don't like bums that are theaves and many are child preditors.

    I don't like the wall of saugage, but I will take a hike today. If I see a bum, I will be sure to push him to move somewhere else..... fricken bleeding hearts have given this country to all the fucked up losers and molesters that crowd our jails and consume are tax dollars. Its time to start clearing the rotten pile of humans out there and make the death penalty a cost effective measure to do away with the bad for society folks such as child molesters and murders.

    Barth makes great points, but nothing will change unless you get Dalager out in November elections. If not, its just more talk and blogging and nothing changes.

  26. I sent the UT this response to their editorial which they have not printed so far. All you have to do to check my facts is go to the EIR posted on the City site - I believe that may be the reason my comment hasn't been printed to date.
    I read your Sunday editorial entitled "A Park for Encinitas " and was surprised to see so much misinformation. To my knowledge, no one who is opposed to the current park plan, is opposed to a park at this location.They are opposed to the density of use of the current plan. If you had taken the time to read the original Traffic segment of the Enviromental Impact report, you would have found that the City's own consultant found the level of service on the I5 on ramps to be unacceptable now and not able to be mitigated until Caltrans and the City agree on a plan. The report goes on to say the planned parking is inadequate for maximum use of the park and envisions shuttles and traffic control a la the Del Mar Fair. The Park, as currently planned, will interact with the Hospital expansion directly across the street, making the section of Santa Fe between the I5 and Devonshire extremely congested - the current plan to deal with this is a series of roundabouts spaced closely together. These are not the only unresolved problems - the use of lights for night use has not been dealt with, control of the Von's parking lot has not even been considered, and the Park ingress and egress is at best, poor. Though many with homes around the Park as proposed have fought the Park, they haven't done so as NIMBYs, but as citizens concerned with the density of use of the proposed Park impacting the whole community.

    This is WRONG that the 'wall' has so callously ignored the wishes of the community.
    Why can the rec.dept. alter the community park plans to create a SPORTS COMPLEX? They just inserted, "...maximize sports fields" into the existing plans with no acklowledged input from anyone. How can they get away with this?

  29. Lets have a community revolt. Hold a sit in when they start the demo. Hold a press conference draw more negative news coverage. That seems to be the only way to expose these crooks. Lets keep throwing mud in their eye, eventually they wont be able to see.

  34. Not a condo person but, my family and I are a huge target because of where we live... near the oh so controversial Orpheus park and also because of what I say. I feel secure because I speak the truth and know how to protect myself, my family and the public. That's my job, that's what I do as a profession and have incorporated that value into my life style.

    As far as I'm concerned bring on the retaliation, I'm already experiencing it. I'm prepared for it and know what to expect and how to react. The city is an easy read, they will just expose themselves further.
