San Elijo Views

An anon comment to a recent post about a San Elijo project focused on motivations of the project appellants, and dismissed the issue of conformance with the law. Anon wrote, "The bottom line is... a small portion of the views of several homeowners in the Cardiff Cove project will be impacted."
I took the above photo a couple days ago and confirmed today that the story poles show the roof lines of the proposed buildings. Click to enlarge the photo. The story poles are on the left.

  7. View ordinances typically do not mandate cutting of plants. They create a process where plants obstructing other views (such as ocean) may be trimmed to include view windows. The first part of a view ordinance would be neighbors trying to "work it out". However, having an ordinance gives the view blockee some leverage to approach the view blocker. Only in a final stage would a committee actually require someone to create a view window.

    Where a plant was the view, the process would not mandate cutting.

    Read the grant deed of trust for your property, no where does it state you have a view of anything. Grow up people.

  10. 11:53 - Don't get the logic on your comment. There are lots of conditions on my property that are a result of zoning and other laws and not expressly stated in my deed. People who want a view ordinance are not claiming that right, they want the city to create a process to allow properties to retain their views. This would be a new right, and therefore laws would be required.

  11. there is no right to a view. remember that. If you currently have a view it can be blocked by another home or trees. Just ask Dr. Lorri. YOu only have a a guaranteed view if you live on the waters edge. Everyone else does not.

  12. View ordinances are a combination of stupidity, greed and just mean spirited. The result seems to be trees being chopped down and the prevention of any new trees going in. Anyone who hasn't maxed-out their property gets the short end of the stick.

    If you want a view, buy a view property. Seems like everyone around this town thinks that their home was somehow special and when combined with their presence are a gift to the community. Nobody seems to think that their place also took away someone's view or added cars, etc.

    A view ordinance would be lame if it cuts away at the development rights and property values of residents. People shouldn't assume that their current view corridor is not encumbered by someone's potential building envelope, per the Encinitas Municipal Code.

    It is important to toss into the conversation that people can always negotiate a view easement their neighbors if they want to ensure their views.

    On the flip side I am all for shoring up the Municipal Code. It currently makes it easy for special people to cheat the EMC. There are a number of cases in Cardiff where people lost their views, not because their neighbors were exercising their property rights, but because they exceeded their property rights.

    Image: So, you check to see if your neighbor's building envelope will obstruct your view, before you buy your house and then somehow your neighbor exceeds the height limit (no variance). Even if you disagree with planning law, planning law is the rules we are suppose to play by and how we determine the price we should pay for our properties.

  34. Fair enough, one more post. I will not say why I quit posting on this blog, except that I am a bit concerned about the lack of transparency that is not being presented by some of the more "famous" bloggers, especially J.P. You will have to ask him what I mean, as I am sure he knows. If he doesn't, then I would be surprised and a bit concerned. No one has gotten to me, as I am Irish and a fighter. Honesty and intelligence are important to me. I don't care if you agree with me, just do not pretend to know something you don't know, or pretend that something is what it isn't. I have nothing to prove to anyone, except myself and the very few people I call my friends. By the way I do consider Lynn and Russell friends and I have always hated the way people keep trashing them. However, that was never enough to keep me off this blog. I have been called many things on this blog. I have always posted by Dr. Lorri. I stand by my words and will answer you honestly if asked. Just like the Mark Muir party. I honestly forgot that part of the post and then added that I had attended a library fundraiser at his home. I could have said I had not, as I don't know if any of you anonymous posters were there. Heck, I do not know who the RSPB is for that matter. The only posters I know who they are, are Left Coast, bbondi, Lynn, Russ, and anyone else who has the courage to post his or her own name. I am actively looking into the intricacies term limits, however I don't need this blog to do it. You have been a part of my life for a very long time and I wish you all well. I will read, I just won't post. so, that is my final answer.
