Busby Fundraiser/Cop Pepperspray Incident

This is in the top 10 stupidest things that has ever happened in Encinitas. Francine Busby who was too lame to defeat our beady eyed congressman Brian Bilbray the last time around, probably thinks she can win the next election because of Obama (she won't) so Busby has some lame boring fundraiser party in Encinitas where they probably drank bad white wine and gossiped about how Michael Jackson and Farrah Fawcett both died. The party attracted some retard right wing stalker who actually hid in the bushes and heckled the party (dude, you need friends). Then some crybaby neighbor complained to the cops that the most boring party in the history of Encinitas was too loud so the sheriffs show up. And why not? It's not like there aren't any fricken crackheads down at Moonlight Beach harassing teenage girls on Saturday nights. So the meathead cop actually freaking peppersprays the hostess of the party!!!
Now that I think of it, I wish went. I would love to see something like that.
ENCINITAS: Hostess of Busby fundraiser pepper-sprayed, arrested
ENCINITAS ---- The 60-year-old hostess of a fundraising shindig for U.S. Congressional candidate Francine Busby was pepper-sprayed and arrested Friday night after she allegedly became combative with a deputy who was there to investigate a noise complaint, sheriff's officials said.
Busby said Saturday the gathering was not loud and described the deputy's use of pepper spray on the hostess and guests as "shocking."
The hostess, Shari Barman, reached through her gate intercom Saturday, declined to talk about the incident.
She said she would release a statement Sunday.
Busby, a Cardiff resident, is a democrat who plans to challenge Republican U.S. Rep. Brian Bilbray for his 50th District congressional seat in 2010. She lost to Bilbray in 2006, when the two were vying for the open seat.
About 9 p.m. Friday, a neighbor complained about noise coming from the party attended by about 50 people at a home in the 1200 block of Rubenstein Avenue, Sheriff's Department spokeswoman Jan Caldwell said.
The oceanview estate is in Cardiff, a few blocks south of Santa Fe Drive.
Busby said the sedate gathering had no music and generated little noise. She guessed the complaint came from an unseen man who spent the evening shouting obscene remarks about democrats and herself from behind a tree in a neighboring lot.
When the deputy arrived around 9 p.m., several dozen guests were still in the house and the front door was open, Busby said.
The deputy came in and was directed to Barman, she said.
The deputy told her about the neighbor's complaint and asked for her name and date of birth, standard information deputies seek when they serve a noise complaint, Caldwell said.
Barman allegedly refused to give her date of birth, argued with the deputy and walked away, Caldwell said.
Caldwell said Barman rushed the deputy after he reached out to grab her. Others in attendance were also becoming argumentative, Caldwell said.
Caldwell said the deputy was worried the guests were becoming unruly and someone might get hurt. He warned Barman twice he would use his pepper spray if she didn't calm down and stop charging him, she said.
The hostess allegedly kept arguing, and the deputy sprayed her, Caldwell said.

9PM and the sheriff shows up for this party being too loud. These are middle aged folks. What is wrong with this picture? Perhaps a little good ole fashioned politics? I want to see the rest of the story, as Paul Harvey would say.

ReplyDeleteJP you advocate that the sheriff should not have come to the party. That would mean that you also advocate the deputies deciding which complaints they should go to. Maybe they shouldn't go to complaints in Leucadia because they don't like the whining cry babies that live there.
Get real.
The P.A. system was turned off at 8PM. And, I have been to many a party where music was blaring long after that. One of our neighbors has parties in Cardiff that last until 1AM. They have an outside deck and that is where the parties are held. Not once have we ever seen a sheriff. But then again, perhaps we have cooler neighbors.

ReplyDeleteI voted for Busby last election. Too bad naieve Francine had to learn the hard way how some authorities would protect and serve her at her own party. Her apponent in running for assembly is Tracey Emblem who is light years ahead of her in that regard, and that's why Emblem is getting my vote this time.

What an asshole that Sheriff is..he had his little ego bruised because the hostess knew her rights -- he was not even lawfully on her property, he didn't have a warrant. Just because a police officer shows up at your door does not mean you have to answer any questions -- and refusing to answer questions does not give the requisite "probable cause" for arrest each and every time. Sheriff could have just written up the noise citation and handed it to her, instead of grabbing her arm -- what a loser. We are not yet living in a police state but coming pretty close to it with this Sheriff dept.

Barman was accused of a crime. Deputy Abbott was investigating a crime. When Law enforcement give tickets of warnings the require a name and a date of birth. How many john smiths do you thing there are out there? She is required to provide this information. If she doesn't she can be detained until that information is provided or learned. The deputy attempted to restrain Barman after several attempts to get her information. Barman decided she was done with the conversation and walked away. She pulled away from the deputy and started screaming. The deputy restrained her with a wrist lock. A large crowd enveloped the deputy and Barman and used force to take Barman from the deputy. This is a felony BTW. The crowd advanced on the deputy and he sprayed them to control them and stop their advance on him. If he's being assaulted, the deputy could have used a lot more force then he did.
ReplyDeleteI know Deputy Abbott. He loves his job and working with the community. He was doing his job and encountered a person who was unwilling to let him walk away with her birthday so he could issue a warning. I'm sure he can't say anything right now because of his job and has been advised not to talk. I'm sure he would love to express his point of view but can't.
These witnesses didn't see the whole story. They only turned to see what happened after Deputy Abbott attempted to detain Barman. If Barman would have identified herself by provided the asked for information this would have never happened. You don't just walk away from a deputy who is investigating a crime. Disturbing the peace is a crime.

ReplyDeleteShe sounds like scumbag elite who think they are above the law. When a cop asks me for ID I give it to him or her. Its not an admission of guilt. The cop probably would have given her a donation if she would have just given him her birthdate.
ReplyDeleteWhen a cop comes to my door and asks to come in, I say NO, not without cause. No need to give a birthdate or anything else. Prove first that there was a noise violation at 9PM. I find the whole thing a bit sketchy. Sounds like a Jerome trick to me.

Just for your and everyone else's information. If there is anyone inside your house deemed a "Fourth Waiver", the sheriff's do not need a search warrant to enter and tear apart your house. A Fourth Waiver is a felon or someone who no longer has his or her 4th amendment rights. Neat, huh? So if someone were to plant a 4th waiver in your home....you get the picture. It makes an end-run around the due process of messy search warrant proceedures and our saftey and privacy as Americans.
But my sympathies to Busby and the guests at her party who got a real look at the people skills some law enforcement officers have here in the county. That's embarrasing. And dangerous in my opinion. Lucky the officer had the brains not to shoot her like an armed guard did Clay Pardee last year or that woman and her child recently in a parking lot.
A few years back a woman in her 60's named Lael at Karlsbad Realty in Carlsbad walked to the liquor store around the corner from her office in Cbad. She bought a 6 pack for her and her husband who were working late. A lady cop followed her back to her business, stood at her front door and demanded that she come outside for a sobriety check. Lael said "I will not!" The woman then entered and physically cuffed her and pulled her outside and arrested her. Lael was not intoxicated.
A friend of hers was the mayor Bud Lewis. After she was released from jail where she was treated horribly, she had cuts and bruises on her wrists, she thought "I'll show Bud, he'll fix this!" She showed Bud and told him the story. He said "You better get a lawyer."
(Some help) But angry because he wouldn't do anything about that officer, she did get a lawyer. She pressed charges against the Cbad PD and won a $75,000 settlement. She then donated all the money to charity.
Perhaps Barham has a similar ax to grind here.
Neither of the people arrested were pepper sprayed. They felt the effects because it was in the air but they were not sprayed.

ReplyDeleteI find the county sheriff's to be power hungry. They love the power of the uniform and it is like a drug to them. Power corrupts. There are some that are much worse than the others, and this is just another example. They will always protect their own.

ReplyDeleteFirst she says that she was in the backyard and had no idea what was going down, now (a few days later) she claims to have seen the whole horrible event.
First she says that the "man in the bush" was shouting anti gay stuff, now she says he was simply shouting the word "loser".
Busby also states that the neihbor who wanted to get some sleep was politicaly motivated. How does she know that if she does not know who he is or what party he supports.
I say vote her out now. Do not contribute to someone who cant keep her story straigh!!!
I believe very few Sheriff's in the county are inept. But it's worrisome how the rest of them usually stand behind one of their own who's in the wrong though, especially when Paul Pfingst was at the helm. In that way it's sometimes cultish IMHO.
ReplyDeleteI remember when Pfingst made Deputy District Attorney Peter Longanbach head of the fraud unit here in San Diego, only to be caught using his secretary for not only his private real estate business, but ordering her to "shuffle defendant's interviews to confuse the defense and assist prosecution". He got busted, his license suspended (for a while) and had to do 100 or more hours worth of public service -teaching children how to golf. But when it came time for him to fulfill his required public service, the boss of the golf course sent him away saying "We don't want any felons around our children, thanks". Good call.
BTW, a lot of people may not believe or realize this, but it seems to be perfectly acceptable for prosecutors to tamper with interview transcripts so that "NO" becomes a "YES" at the turn of a page - completely changing a persons answer to the most incriminating questions. I don't think Longanbach's penalty even considered the interview tampering he did. But if you're ever "interviewed" by the police or sheriff in San Diego County, I'd advise you to do two things. Get a lawyer to be present with you and request audio and transcript copies of the interview so that you can compare them, making sure your words aren't being played with. Shuffling them, then numbering them as though they are in order must be a pattern problem in San Diego County as it not only occured under Longanbach, but under Deputy District Attorney Thomas Manning in the Cheri Dale case as well. (34 pages of her interview were sequentially void and her court appointed lawyer Michael Berg failed to tell the judge or jury that at her bogus murder trial.) Cheri Dale is my sister and was with me the entire morning of the murder on which Susan Taylor was killed in La Costa (on 1-25-90). Her lawyer (of course) said I'd take the stand at trial. That didn't happen and her jury only got to hear the prosecutor's impossible scenario.
But back to Ms. Barman. I would assume she already has a lawyer who has told her not to talk to the press - and that's why she's mute in the media. Another big mistake in my opinion. Her lawyer probably got the whole crowd at the party gagged too. When they take away our free speech like that I think it does at least three things.
1: Hides all prosecutorial wrong doing that may have occured. 2: Makes the lawyer look like a genius if he wins the case, and 3: allows the lawyer to not have egg on his face when he loses the case, easily sweeping it under a carpet, and no archive available of anyone's discontent. Quite a protection mechanism for the defense and prosecutor - at the expense of the public really hearing both sides. We've only heard one so far haven't we?

ReplyDeleteIt would be nice if the sheriff would find out who did place that call. Couldn't be that hard to trace the call could it? If I were the sheriff that is what I would do. It would take the heat off the officer and put it where belongs. If it was the neighbor, I hope the sheriff also has a little talking to him or her. This is all B.S. Let's face it, did the sheriff really need a helicopter with a bunch of old folks, and mostly women? If they are that afraid perhaps they are in the wrong business? A transfer to a desk job ma be in order. No danger there.
